Is it against the law to refuse to give a dental patient their dental records, ie. x-rays,history, etc.?

I'm a little concerned that my son's dentist is trying to treat him for dental issues he does not have. He was seen yesterday and had three silver caps put on over back bottom and top teeth. They are telling me that I need to bring him in to do the opposite side...same problem. My son does grind his teeth which has caused a few issues but his teeth are very well taken care of by me. He brushes twice a day and I follow behind him with a thorough brushing. We also floss every other day. Not a lot of sweets and no soda.... I thougth about getting a 2nd opionion and requested his dental records so the 2nd dentist could compare notes. The office manager told me it was against their policy to release dental records.... Doesn't sound right to me....help!

By law in all 50 states, dentists are required to give copies of records to patients when asked. They can keep the originals but copies must be provided upon request or demand. The dentist can also charge a fee to cover duplication costs. Although the side that is already treated cannot be checked to see if the original work was necessary, the untreated side can. An x-ray from the original dentist may not be necessary but if so, only a single bitewing will provide enough information to the dentist doing the second opinion. That can be taken at the new office and should not cost too much if you have problems getting the records in a timely manner.
