Ex won't pay for daughter's dental treatment, what to do?

Wednesday, January 26, 2011

My 4 year old daughter has two abscessed front baby teeth. Her pediatric dentist has referred her to an oral surgeon to have them both extracted. He says this is the only way to treat them at this point. My daughter's dad is a physician and adamantly refuses to pay for the procedure and he no longer pays me child support to provide me with any means to pay for it myself. I am a stay at home mom due to my daughter's severe autism and because of her father's income she qualifies for no assistance from the state. She has medical insurance but no dental. He has the means to pay for this treatment but just won't. I'm very concerned for my daughter's well being since a tooth abscess can become very serious very quickly. I have an emergency hearing scheduled but it won't go in front of a judge for several months and she needs to have this taken care of ASAP. He's always paid all her out of pocket medical bills in full but because this expense is so large he just won't want to pay it. How can I force him to pay for her treatment?

Unfortunately going through the court system is the only way to force. Most hospitals have financial plans you can apply for. Since you have no income her care could be free. This is not a proud moment for you but it is not you that is of concern now. You have to do what you have to do. Asking for help is not shameful. Don't be afraid to ask. Don't forget to bring this up in court as well. You should also ask the judge to require him to carry medical insurance on her. Talk to a lawyer. If your case is strong enough, alot of them will go after him for their fee. First meeting or phone consultation is most often free.
